End User License Agreement (EULA)

1. Overview

This End User License Agreement ("Agreement") is a legal agreement between you and JBLZ Pty Ltd ("JBLZ", "we", "us", or "our") governing your use of the Triggr mobile application, including any updates, content, and services provided through it (collectively, the "App"). By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not install or use the App.

2. License Grant and Scope

Subject to your compliance with this Agreement, JBLZ grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use one copy of the App on a device that you own or control and solely for your personal, non-commercial use. All rights not expressly granted are reserved by JBLZ.

3. Eligibility and Acceptable Use

  • You must be at least 13 years old to use the App.
  • You will not copy, modify, reverse engineer, decompile, disassemble, or attempt to derive the source code of the App except as permitted by law.
  • You will not use the App in any unlawful, harmful, or abusive manner, and you will respect the privacy and consent of others.

4. Health Notice

The App is a wellness tool and is not a medical device or a substitute for professional care. It does not provide clinical diagnoses, treatment, or emergency services. If you are in crisis, call your local emergency number or seek professional help immediately.

5. App Store and Google Play Terms

If you obtained the App through the Apple App Store or Google Play, your use of the App is also subject to the respective platform’s terms and policies:

  • Apple App Store: Apple Media Services Terms and Conditions and the Apple Licensed Application End User License Agreement (if applicable).
  • Google Play: Google Play Terms of Service and Google Play Policies.

To the extent this Agreement conflicts with those terms, the platform terms will govern solely with respect to the conflicting provision.

6. Maintenance and Support

JBLZ is solely responsible for providing any maintenance and support for the App as required by applicable law or as described in this Agreement. Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the App.

7. Product Claims

JBLZ is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation. Apple and Google are not responsible for such claims.

8. Intellectual Property

All intellectual property rights in and to the App are owned by JBLZ and its licensors. In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, JBLZ will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

9. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and processing of information as described there.

10. Third-Party Services and Content

The App may display or link to third-party content or services. JBLZ is not responsible for third-party content, services, or policies. Your use of any third-party services is at your own risk and subject to their terms.

11. Termination

We may suspend or terminate your access to the App at any time if you violate this Agreement or if necessary to protect users or comply with law. You may terminate this Agreement by uninstalling the App. Upon termination, the rights granted to you will end immediately.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. YOUR USE OF THE APP IS AT YOUR SOLE RISK.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JBLZ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE APP OR THIS AGREEMENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL JBLZ’S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Export, Sanctions, and Legal Compliance

You represent that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable export control and sanctions laws and regulations.

15. Apple and Google as Third-Party Beneficiaries

Apple, and Apple’s subsidiaries, are third-party beneficiaries of this Agreement. Upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary. Google is not a party to this Agreement and is not a third-party beneficiary, but may rely on your compliance with its platform terms.

16. Governing Law

Except where prohibited by law, this Agreement is governed by the laws of New South Wales, Australia, without regard to its conflict of law principles. You submit to the exclusive jurisdiction of the courts located in New South Wales for any disputes arising out of or relating to this Agreement or the App.

17. Changes to this Agreement

We may update this Agreement from time to time. If we make material changes, we will notify you within the App or by email. Your continued use of the App after changes take effect constitutes acceptance of the updated Agreement.
